Railway loses suit against Oyo

A High Court in Ibadan on Monday struck out the suit filed by the Railway Property Management Company Limited against the Oyo State Government for want of diligent prosecution.

The court was presided over by Justice O.I.Aiki.
The company had sued the Oyo State Government challenging the revocation of its parcels of land by the government.
The parcels of land in dispute was said to been hitherto vested in the Nigerian Railway Corporation except those being used for rail track and railway staff quarters for overriding public interest.
The court struck out the case on the ground that the action of the claimant fell short of prosecuting the matter with due diligence deserving of a suit being heard as a matter of urgency during the court’s vacation.
In the meantime, the Oyo State Government has given what it called a final notice to all persons “be it natural, corporate or incorporate whose root of titles are derived from the Nigerian Railway Corporation and Railway Property Management Company Limited.”
In a notice by the State Attorney General, Mr Bayo Ojo, the government said the notice on the property became imperative in view of the revocation.
The notice urged anyone whose title had become voided to contact the Ministry of Land , Housing and Surveys of Oyo State in respect of such void titles forthwith.
